By accessing, registering, or purchasing any course on Fluenza, you agree to be legally bound by these Terms and Conditions. If you do not agree, you must not use this Platform. These Terms constitute a legally binding agreement between you and Fluenza.

1 Acceptance of Terms

By accessing, registering on, or purchasing any course through Fluenza (“Platform”, “we”, “us”, or “our”), you (“User”, “you”) agree to be legally bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you must not access or use the Platform.

By using this Platform, you confirm that:

  • You are at least 18 years of age; or
  • You are accessing the Platform with the knowledge and consent of a parent or legal guardian who also agrees to these Terms on your behalf.

Where users are located in the UAE or Saudi Arabia, the age of legal capacity may be 21 years. Users in those jurisdictions confirm they meet the applicable legal age requirement or have obtained appropriate parental or guardian consent.

2 Company Information

Fluenza is operated from India. All services are deemed to be provided from India, and all agreements entered into through this Platform are governed by Indian law. Fluenza is currently an unregistered business entity in the process of formalising its legal structure.

3 Nature of Services

Fluenza provides digital educational content delivered entirely online. Our services include, but are not limited to:

  • Pre-recorded video lessons
  • Downloadable study materials
  • Quizzes, exercises, and assessments
  • Online learning modules and structured courses

All courses are delivered digitally. No physical products are shipped. Course access is granted upon successful payment confirmation.

The Platform is offered in English. Some course materials may include content in other languages as part of the learning curriculum.

4 Payments & Pricing

  • All prices are displayed in the currency shown at checkout. Fluenza currently accepts payments in INR, USD, and AED. The applicable currency will be displayed clearly before you confirm your purchase.
  • Full payment must be completed before course access is granted.
  • Prices are subject to change at any time without prior notice. The price applicable to your purchase is the price shown at the time of checkout.
  • Users are solely responsible for any foreign exchange conversion fees, bank charges, or transaction fees charged by their payment provider.
  • Fluenza uses third-party payment processors (including Razorpay). By making a payment, you also agree to the terms of the applicable payment processor.
  • GST or other applicable Indian taxes may be added to your order where required by law. International users are responsible for any import duties, VAT, or local taxes applicable in their own country.

Once payment is successfully processed, course access is granted automatically. If you experience a payment issue, please contact us promptly at fluenza.org.

5 No Refund Policy

All purchases made on Fluenza are final and non-refundable. Given the digital nature of our products and the immediate access granted upon payment, Fluenza operates a strict no-refund policy.

No refunds will be issued for any of the following reasons:

  • Change of mind after purchase
  • Failure or inability to complete the course
  • Lack of time or personal circumstances
  • Technical incompatibility with your device or browser
  • Internet connectivity issues on your end
  • Dissatisfaction with course style, pace, or content
  • Accidental or unintended purchase
  • Partial use of course content

By completing a purchase, you expressly acknowledge and agree to this no-refund policy.

Chargebacks & Payment Disputes
Initiating an unjustified chargeback or payment reversal with your bank or card provider is considered a breach of these Terms. In such cases, Fluenza reserves the right to immediately suspend or permanently terminate your account, revoke all course access, and pursue legal recovery of funds owed, including any associated costs and fees.

Exception: In the rare event that Fluenza is unable to provide access to a purchased course due to a technical failure or error on our part, we will offer either a course credit or resolution at our sole discretion. This exception does not apply to issues caused by the user’s device, browser, or internet connection.

6 License & Permitted Use

Upon successful purchase, Fluenza grants you a limited, personal, non-exclusive, non-transferable, non-commercial licence to access and view the course content solely for your own personal educational use.

You may NOT:

  • Share your login credentials or account access with any other person
  • Record, screenshot, download, or reproduce any course content without prior written permission
  • Upload, publish, or redistribute course content on any platform, website, or channel
  • Sell, sublicense, or otherwise transfer your access or the course content to any third party
  • Use course content for commercial training, corporate workshops, or any revenue-generating activity without a separate written agreement with Fluenza

Violation of this licence may result in immediate account termination and legal action under applicable intellectual property laws.

7 Intellectual Property

All content available on the Platform, including but not limited to videos, text, audio, course structure, graphics, logos, branding, software, and user interface design, is the exclusive intellectual property of Fluenza or its licensed content creators, and is protected under applicable Indian and international intellectual property laws.

Nothing in these Terms grants you any ownership right or interest in the Platform or its content. Any unauthorised use, reproduction, or distribution constitutes infringement and may be subject to civil and criminal liability.

8 User Conduct

You agree to use the Platform responsibly and lawfully. You must not:

  • Attempt to hack, probe, or disrupt the Platform or its servers
  • Use bots, scrapers, or automated tools to access or extract content
  • Upload, transmit, or distribute harmful, illegal, or offensive content
  • Misuse payment systems or engage in fraudulent transactions
  • Impersonate any person, instructor, or entity
  • Engage in any activity that violates applicable laws in India, the UAE, Saudi Arabia, or your country of residence

Fluenza reserves the right to suspend or permanently terminate accounts that violate these conduct standards, without notice and without refund.

9 Access & Availability

Fluenza aims to provide consistent and reliable access to purchased courses. However, we do not guarantee:

  • Uninterrupted or error-free access to the Platform
  • Permanent availability of any specific course or module
  • Compatibility with all devices, browsers, or operating systems

Courses may be updated, modified, or retired at any time. Where a course is permanently removed, Fluenza will make reasonable efforts to provide advance notice to enrolled users. Access to purchased courses is provided for a reasonable period, currently defined as 12 months from the date of purchase unless otherwise stated on the course page.

10 Educational Disclaimer

Fluenza provides educational content for personal learning and skill development purposes only. While we strive for high-quality instruction, we do not guarantee:

  • Fluency or proficiency in any language upon course completion
  • Success in any examination, certification, or standardised test
  • Employment, career advancement, or any specific professional outcome
  • Any specific learning outcome or rate of progress

Individual results will vary depending on prior knowledge, personal effort, practice frequency, and other individual factors. Course content is intended to supplement, not replace, formal education or professional language instruction.

11 Limitation of Liability

To the maximum extent permitted by applicable law, Fluenza, its operators, instructors, and affiliates shall not be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of income, business opportunity, or data
  • Technical disruptions, outages, or failures beyond our reasonable control
  • User device or software incompatibility issues
  • Any loss arising from reliance on course content

In any event, Fluenza’s maximum aggregate liability to you shall not exceed the amount you paid for the specific course giving rise to the claim.

Your use of the Platform is entirely at your own risk. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by our negligence, to the extent such exclusion is prohibited by applicable law.

12 Data Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, storage, and processing of your personal data as described in the Privacy Policy.

Fluenza complies with applicable Indian data protection laws, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023. We also respect the data protection principles applicable to users in the UAE and Saudi Arabia.

13 Account Termination

Fluenza reserves the right to suspend, restrict, or permanently terminate your account and revoke access to all courses in the following circumstances:

  • Breach of any provision of these Terms
  • Violation of our intellectual property rights
  • Fraudulent activity or payment disputes
  • Conduct harmful to other users or the Platform

No refund will be issued upon termination where the termination is due to a breach of these Terms. Fluenza may also terminate accounts where required by law or court order.

14 Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising out of or in connection with these Terms, including any questions regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra, India.

Users in the UAE and Saudi Arabia acknowledge that by using this Platform, they consent to the jurisdiction of Indian courts for the resolution of any disputes, without prejudice to any mandatory consumer protection rights they may hold under their local law.

15 Amendments

Fluenza reserves the right to update or modify these Terms at any time. Where changes are material, we will make reasonable efforts to notify registered users. The updated Terms will be posted on this page with a revised effective date.

Your continued use of the Platform after any such changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
